These Terms of Service govern your use of simoneandivy.ca and any purchases or services offered by Simone & Ivy. Throughout these Terms, “Simone & Ivy,” “we,” “us” and “our” refer to Simone & Ivy. “You” and “your” refer to any person who visits our website, creates an account, places an order or uses our products or services.

By accessing our website, placing an order or using our services, you agree to these Terms of Service and the policies referenced within them. If you do not agree, please do not use our website or services.

Nothing in these Terms limits any rights or remedies available to you under applicable consumer protection laws.

Our Online Store

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and services online.

You may use our website only for lawful, personal or legitimate business purposes. You must not use the website in a way that violates applicable law, infringes another person’s rights, compromises security or interferes with the website’s operation.

We may suspend or restrict access to our website when reasonably necessary to protect Simone & Ivy, our clients, our service providers or others.

Eligibility & Accounts

You must be at least the age of majority in your province or territory to place an order, or you must have the permission and supervision of a parent or legal guardian.

When creating an account or placing an order, you agree to provide current, complete and accurate information.

You are responsible for:

• Keeping your account credentials confidential
• Activity completed through your account
• Updating your contact, billing and payment information
• Notifying us promptly if you believe your account has been accessed without authorization

We may close or restrict an account that is used fraudulently, unlawfully or in violation of these Terms.

Product Information

We make reasonable efforts to ensure that product descriptions, dimensions, images, pricing and availability are accurate. However:

• Measurements are approximate unless stated otherwise
• Colours and finishes may appear differently depending on lighting, photography and screen settings
• Handmade and natural products may vary in colour, grain, texture, pattern, movement and finish
• Product packaging and minor design details may change
• Availability and lead times may change without notice

Variations inherent in natural materials or handcrafted products are expected characteristics and are not considered defects.

If exact measurements, colours, finishes or other details are important to your purchase, please contact us before ordering.

Prices, Taxes & Currency

Unless otherwise stated, prices displayed on our Canadian website are in Canadian dollars.

Applicable taxes, shipping, delivery and other disclosed charges are added at checkout. The total amount payable will be displayed before you submit your order.

Prices and promotions may change without notice. A price change does not affect an order that we have already accepted, except where the original price resulted from an obvious error.

Discount codes, promotional offers and gift cards are subject to any additional terms presented with them. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively or redeemed for cash.

Orders & Acceptance

Submitting an order is an offer to purchase the products or services shown in your cart.

After you place an online order, we will send an order confirmation to the email address provided. We reserve the right to review, accept, decline or cancel an order where reasonably necessary, including when:

• An item is unavailable
• Product or pricing information contains an obvious error
• Payment cannot be authorized
• The order is identified as potentially fraudulent
• Delivery cannot reasonably be arranged
• The order appears to be intended for unauthorized resale
• The order would violate a law or restriction

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method, subject to any rights or obligations required by law.

We may limit purchase quantities per person, household, account, payment method or order.

Payment

You authorize Simone & Ivy and its payment providers to charge the payment method selected at checkout for the total amount shown.

Payment information is processed through Shopify or another authorized payment provider. We do not generally receive or store your complete payment card number.

You are responsible for ensuring that your billing and payment information is accurate and that you are authorized to use the selected payment method.

Order Changes & Cancellations

Cancellation requests for standard online orders must be submitted within 24 hours of purchase.

Cancellation or change requests for custom and made-to-order items must be submitted within 48 hours of purchase. After that period, custom and made-to-order items cannot be changed, cancelled or returned.

Orders cannot be cancelled after they have shipped.

Nothing in this section limits a cancellation right that applies under mandatory consumer protection law.

Custom Furniture & Special-Order Products

Custom furniture, made-to-order products and special-order rugs are ordered specifically for the client and are final sale.

The client is responsible for confirming:

• Product dimensions and configuration
• Fabric, colour and finish selections
• Room measurements and intended fit
• Doorway, stairway, elevator and other access measurements
• Delivery and installation requirements

We are happy to provide product information and general guidance, but the client remains responsible for final selections, measurements and fit.

Lead times are estimates and may be affected by production, supply-chain, weather, transportation or other circumstances beyond our reasonable control.

Shipping, Delivery & Pickup

Shipping, delivery and pickup availability varies by product, destination and service selected.

Clients are responsible for providing a complete and accurate shipping address and ensuring that the delivery location is accessible and safe.

Returns, Exchanges & Final Sale Items

Returns, exchanges and store credits are governed by our Return & Exchange Policy.

Certain products are final sale, including:

• Custom furniture
• Special-order rugs
• Floor models
• Items discounted by 20% or more
• Consumable and personal care products
• Live plants

Nothing in our policies limits any non-waivable rights or remedies available under applicable law.

Damaged or Defective Products

Damage must be reported within 48 hours of shipping, delivery or pickup. Please retain the original packaging and email hello@simoneandivy.ca with your order number and clear photos of the item, packaging and damage.

Damage caused during transportation, handling or assembly by the client or another third party after pickup is not considered shipping or manufacturer damage.

Manufacturer-defect claims submitted within six months may be reviewed, subject to assessment and any applicable manufacturer warranty.

Normal wear, accidental damage, misuse, improper care and expected variations in handmade or natural materials are not considered manufacturer defects.

Subscriptions & Recurring Purchases

The S&I Seasonal Refresh Box requires an initial one-year commitment consisting of four seasonal boxes. The first payment is charged when the subscription begins. Subsequent payments are processed quarterly on the 11th of February, May, August and November.

After the fourth box has shipped, the subscription automatically renews each season until cancelled. Cancellation requests must be received before the next scheduled payment is processed. A cancellation submitted after payment has been processed will take effect for the following season.

Seasonal Refresh Boxes and the individual items included in them are final sale and cannot be returned or exchanged.

Gift Cards & Store Credit

Gift cards and store credits:

• May be used toward eligible Simone & Ivy purchases
• Cannot be redeemed for cash except where required by law
• Cannot be replaced if lost, stolen or used without permission unless required by law
• May not be used to purchase another gift card
• Remain subject to any terms disclosed when issued

Promotional credits may have separate conditions or expiry dates where permitted by law.

Reviews, Photos & Other Submissions

If you submit a product review, photograph, comment, contest entry or other content, you confirm that:

• You created or have permission to submit the content
• The content is accurate and not misleading
• The content does not infringe another person’s rights
• The content is not unlawful, defamatory, abusive, discriminatory, obscene or malicious
• The content does not contain harmful code, spam or unauthorized advertising

You retain ownership of your content. By submitting it, you grant Simone & Ivy a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish and display it for operating, improving and promoting our business, products and services.

Where reasonably possible, we will honour a request to stop using identifiable client-submitted content in future marketing. This does not require us to recall materials already printed, distributed or published.

We may moderate or remove content that violates these Terms, but we are not required to monitor all submissions.

Intellectual Property

The website and its contents—including text, photography, graphics, logos, product descriptions, page layouts, videos and other materials—are owned by Simone & Ivy or used with permission and are protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial shopping and informational purposes.

Without our written permission, you may not:

• Copy, reproduce or republish substantial portions of the website
• Use our photographs, branding or content for commercial purposes
• Modify, distribute, sell or exploit website content
• Remove copyright, trademark or ownership notices
• Represent yourself as affiliated with Simone & Ivy

“Simone & Ivy” and associated branding may not be used in a way that suggests endorsement, sponsorship or affiliation without written permission.

Prohibited Uses

You must not use our website or services to:

• Violate any applicable law or regulation
• Infringe intellectual property, privacy or other legal rights
• Submit false, misleading or fraudulent information
• Harass, threaten, abuse, discriminate against or harm another person

Website Availability & Errors

We try to keep our website accurate, secure and available. However, we do not guarantee that:

• The website will always be uninterrupted or error-free
• All content will always be accurate, complete or current
• Every feature will remain available
• Technical issues will be corrected immediately

We may correct errors, update content, change features or temporarily suspend access when reasonably necessary.

If an error affects an order you have placed, we will contact you when appropriate and provide any remedy required by law.

Disclaimer of Warranties

Except for warranties, conditions or rights that cannot legally be excluded, our website and online services are provided on an “as available” basis.

To the maximum extent permitted by law, we do not make additional warranties regarding uninterrupted website availability, compatibility with every device or the complete accuracy of general informational content.

This section does not exclude or limit:

• Mandatory consumer protections
• Applicable manufacturer warranties
• Our obligations regarding products purchased from us
• Liability that cannot legally be excluded

Limitation of Liability

To the maximum extent permitted by law, Simone & Ivy and its directors, employees, contractors, service providers and representatives will not be liable for indirect, incidental, special or consequential losses arising solely from the use of, or inability to use, our website.

This limitation does not apply to:

• Liability that cannot legally be limited or excluded
• A breach of mandatory consumer rights
• Gross negligence or wilful misconduct
• Personal injury or property damage caused by conduct for which liability cannot legally be excluded
• Remedies expressly provided under another Simone & Ivy policy or applicable law

For claims that may legally be limited, our total liability will not exceed the amount paid for the product or service giving rise to the claim.

Indemnification

To the extent permitted by law, you agree to reimburse Simone & Ivy for reasonable losses, liabilities and expenses resulting directly from:

• Your unlawful use of our website
• Your material breach of these Terms
• Content you submit that infringes another person’s rights
• Fraudulent or malicious conduct by you

This section does not apply to ordinary consumer complaints or prevent you from exercising rights available under consumer protection law.

Mobile Messaging Terms

The Simone & Ivy mobile messaging service allows subscribers to receive promotional and service-related text messages.

By expressly subscribing, you agree to receive recurring SMS or text messages from or on behalf of Simone & Ivy at the mobile number you provide. Messages may include order updates, account notices, cart reminders, promotions, product information and special offers.

Consent to receive promotional text messages is voluntary and is not a condition of purchasing from Simone & Ivy.

Message frequency varies. Simone & Ivy does not charge for the service, but standard message and data rates from your wireless carrier may apply. You are responsible for charges imposed by your carrier.

You may unsubscribe at any time by replying STOP to +1 833-436-6865 or by using the unsubscribe option included in a message, where available. You may receive one final message confirming your opt-out.

You are responsible for providing a valid mobile number and updating your information if your number changes. Wireless carriers are not responsible for delayed or undelivered messages.

Changes to Our Services or Products

We may modify, suspend or discontinue website features, products or services at any time.

Product prices, selection and availability may change without notice before an order is placed.

We may update these Terms to reflect changes to our services, business practices or legal obligations.

The revised Terms will be posted on this page with an updated revision date. Material changes will apply prospectively unless otherwise required by law.

These Terms and your use of our website are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.

Subject to any rights you have under applicable consumer protection law, disputes will be submitted to the courts located in Alberta.

If any part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed only to the extent necessary. The remaining Terms will continue in effect.

No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations in connection with a sale, reorganization or transfer of all or part of our business, subject to applicable law.

Entire Agreement

These Terms, together with the policies and terms referenced within them, form the entire agreement relating to your use of our website and applicable purchases or services.

If product-specific, subscription, promotional or service terms conflict with these general Terms, the more specific terms will apply to that product, subscription, promotion or service.
